Terms & Conditions

All services are in the form of our "Addon" products and are herein referred to as "Addons" and or Services.

1. Acceptance

By ticking the "I have read and agree to the CartBuzzard.com Terms and Conditions" check box on any online form within the www.cartbuzzard.com (or affiliate or sub-site) website/s, or alternatively by signing this contract, you are indicating agreement to and acceptance of these Terms and Conditions.

2. Charges

Charges for services provided by CartBuzzard.com are as defined during the Addon installation process. CartBuzzard.com reserves the right to change the rates for services with not less than thirty (30) days advance notification to the Customer.

3. Payment

The Customer may elect and maintain their payment preferences via their control panel within CartBuzzard.com. The Customer may elect to receive e-mail invoices. Invoices are due upon receipt. Accounts that remain unpaid thirty (30) days after the date of invoice may be assessed a service charge in the amount of one and one-half percent (1.5%) per month of the total amount due.

4. Default

Accounts unpaid thirty (30) days after the date of invoice will be considered in default. If the Customer in default maintains any Addons, they may be disabled at the discretion of CartBuzzard.com. Removal of Addons does not relieve the Customer of its obligation to pay any outstanding charges owed by the Customer. Customers with accounts in default agree to pay CartBuzzard.com's reasonable expenses, including solicitor fees and costs for collection by third-party agencies, incurred in enforcing these Terms and Conditions.

5. Termination

Either party may terminate their account at any time. Customers can request account termination via their CartBuzzard.com Account Control panel at https://www.cartbuzzard.com/account.php.

6. Returns on Checks or Credit Cards

If the bank returns a check or fails to honor your credit card:

6.1. There will be a $25.00 insufficient funds charge;

6.2. You will be notified by e-mail that your check or your credit card was not accepted;

6.3. Your service will be suspended until the balance and the service charges are received in our office;

6.4. The account will be immediately considered to be in default until full payment is received.

7. Legal Restrictions

CartBuzzard.com's services may be used for lawful purposes only. Submission, transmission, or maintenance of any information or materials in violation of any United States of America laws, acts or regulations is prohibited. This includes, but is not limited to, material legally judged to be threatening or obscene.

The Customer must:

7.1 respect the conventions of the newsgroups, lists and networks used;

7.2 respect the legal protection afforded by copyright, trademarks, license rights and other laws to materials accessible via the CartBuzzard.com service;

7.3 respect the privacy of others;

7.4 use the service in a manner that does not interfere with or disrupt other network users, services or equipment; and

7.5 refrain from acts that waste resources or prevent other users from receiving the full benefit of CartBuzzard.com' services. CartBuzzard.com reserves the right to refuse service to the Customer without providing reason or cause

8. Indemnity

The Customer agrees to indemnify and hold harmless CartBuzzard.com from any and all claims resulting from:

8.1 the Customer's use of CartBuzzard.com's services which cause damage or loss to the Customer or a third party; and

8.2 a third party illegally obtaining access to the site and causing damage or loss.

9. Disclaimer

CartBuzzard.com makes no warranties of any kind, whether express or implied, for the services it provides. CartBuzzard.com also disclaims any warranty of merchantability or fitness for a particular purpose. CartBuzzard.com will not be responsible for any direct, indirect or consequential damages which may result from the use of its services including loss of data or profit resulting from delays, non-delivery or interruption in service.

10. General

These Terms and Conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. The Customer's submission of the Addon Installation form constitutes agreement to and acceptance of these Terms and Conditions.
